DEBT ALLOCATION IN A DISSOLUTION OF MARRIAGE


On dissolution or legal separation, debts incurred by either spouse after the date of marriage but before the date of separation must be divided as set forth in Family Code Sections 2550–2552.


In general, and with certain exceptions, this means that debts incurred by either spouse after the date of marriage but before the date of separation usually must be divided equally.
