COMMUNITY IS LIABLE FOR EACH SPOUSE'S DEBTS DURING MARRIAGE


Pursuant to CA Family Code section 910


The spouses’ community estate property is liable for any debt incurred by either spouse during marriage, regardless of which spouse has management and control of the property and regardless of whether one or both spouses are parties to the debt or to a judgment for the debt.


For purposes of determining the liability of community property under these circumstances, however, the term “during marriage” does not include the period after the date of separation, but before entry of a judgment of marital dissolution or legal separation
