FAMILY LAW SANCTIONS AGAINST AN ATTORNEY AND OPPOSING PARTY


Under C.C.P. 128.7, an attorney and his client may be sanctioned for filing a paper, pleading or motion, for the purpose of harassing, causing unnecessary delay, needless increase in the cost of litigation or other frivolous purpose.


If warranted, the court may award to the party prevailing on the motion for sanctions the reasonable expenses and attorney’s fees incurred in presenting or opposing the motion.
